1. Acceptance of Terms
By accessing or using the FieldIntake service, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the service.
2. Description of Service
FieldIntake provides an AI-powered phone answering service for home service contractors. The service includes: automated call answering, AI-assisted information gathering, call recording and transcription, service order creation, and SMS/email notifications.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the legal authority to bind the business you register.
4. Subscription and Billing
- Plans are billed monthly. Prices are listed on our website and may change with 30 days notice.
- Each plan includes a set number of calls per month. Calls exceeding your plan limit are billed at $0.50 per additional call.
- You may upgrade, downgrade, or cancel your plan at any time. Changes take effect at the next billing cycle.
- Refunds are available within the first 30 days if you are not satisfied with the service.
5. Phone Numbers
FieldIntake provides a dedicated phone number for your account. This number is leased and remains the property of FieldIntake. If your account is cancelled or deactivated, the phone number will be released and may be reassigned.
6. AI Service Limitations
The AI assistant is designed to collect information from callers accurately, but it is not infallible. FieldIntake does not guarantee that all information captured will be 100% accurate. You are responsible for verifying critical details with your customers before performing any work.
7. Call Recording
All calls handled by FieldIntake are recorded. You are responsible for ensuring compliance with applicable call recording laws in your jurisdiction, including providing notice to callers where required. FieldIntake is not liable for your failure to comply with local recording consent laws.
8. Acceptable Use
You agree not to:
- Use the service for any illegal or unauthorized purpose.
- Attempt to interfere with or disrupt the service or its infrastructure.
- Use the service to make outbound calls, send spam, or engage in telemarketing.
- Share your account credentials with unauthorized third parties.
9. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. FieldIntake is not liable for losses resulting from service outages, network failures, or third-party provider issues.
10. Limitation of Liability
FieldIntake is not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including lost revenue, lost customers, or missed calls. Our total liability shall not exceed the amount you paid for the service in the preceding 12 months.
11. Termination
We may suspend or terminate your account if you violate these terms or fail to pay your subscription. You may cancel your account at any time through the dashboard or by contacting us.
12. Changes to Terms
We may update these terms from time to time. We will notify you of material changes via email. Continued use of the service after changes constitutes acceptance of the new terms.
13. Governing Law
These terms are governed by the laws of the Commonwealth of Puerto Rico. Any disputes shall be resolved in the courts of Puerto Rico.
